Terms of Service

1. The Service

Adamir provides a Shopify application that helps merchants benchmark their store against top-performing Shopify stores, discover conversion tactics, and compare product, theme, and performance signals. We may add, modify, or remove features at any time.

2. Eligibility and Account

To use the App you must operate an active Shopify store and comply with Shopify's Terms of Service. By installing the App, you authorize us to access your store data through the OAuth scopes you approve at installation time. You are responsible for maintaining the confidentiality of your Shopify account credentials.

3. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Use the App to violate any applicable law, regulation, or third-party right.
• Interfere with or disrupt the App's infrastructure or security mechanisms.
• Use automated scraping, crawling, or extraction tools against the App beyond its documented API.
• Resell, redistribute, or sublicense access to the App without our written permission.

4. Fees

The App may be offered on a free tier, a paid subscription, or a combination. Current pricing is displayed on the Shopify App Store listing and within the App admin. All fees are billed through Shopify's billing API and are non-refundable except where required by law or Shopify policy. We may change pricing at any time with at least 30 days' notice.

5. Your Data and Privacy

Our handling of personal information is described in our Privacy Policy. You retain all rights to the data in your Shopify store. By installing the App, you grant us a limited license to access, process, and store that data solely to provide the App's features to you.

6. Intellectual Property

The App, including all software, designs, text, graphics, and branding, is owned by Adamir and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand elements.

7. Third-Party Services

The App relies on Shopify and other third-party providers (hosting, database, email) to operate. We are not responsible for the availability, content, or practices of those third parties. Your use of Shopify is governed by Shopify's own terms.

8. Termination

You may uninstall the App at any time through your Shopify admin. We may suspend or terminate your access to the App immediately, without notice, if we believe you have violated these Terms, created risk or legal exposure for us, or if continued provision of the App to you is no longer commercially viable. Upon termination, the licenses granted to you under these Terms end immediately.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or that the App will be uninterrupted or error-free. Any insights, benchmarks, or recommendations provided by the App are informational only and do not constitute business, legal, or financial advice.

10. Limitation of Liability

To the maximum extent permitted by law, in no event will Adamir be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with these Terms or your use of the App. Our total aggregate liability to you for all claims arising from or relating to the App will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).

11. Indemnification

You agree to defend, indemnify, and hold harmless Adamir from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the App, your violation of these Terms, or your violation of any third-party right.

12. Governing Law

These Terms are governed by the laws of the United States and the state in which Adamir is registered, without regard to conflict of law principles. Any dispute arising from these Terms will be resolved in the state or federal courts located in that jurisdiction, and you consent to their personal jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated Terms at this URL and revise the "Effective" date at the top. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
